la TSCA. La Agencia de Protecci\u00f3n Medioambiental de Estados Unidos (EPA, por sus siglas en ingl\u00e9s) lo mantiene actualizado y publica los cambios cada seis meses en una secci\u00f3n no confidencial del inventario. La lista puede consultarse gratuitamente en l\u00ednea con una funci\u00f3n de b\u00fasqueda en la EPA y la versi\u00f3n m\u00e1s reciente tambi\u00e9n puede descargarse directamente de la EPA. Desde la primera versi\u00f3n del inventario, que inclu\u00eda 62.000 sustancias qu\u00edmicas, el Inventario TSCA ha crecido hasta las 86.000 sustancias qu\u00edmicas. La EPA recibe alrededor de 400 nuevas notificaciones de sustancias cada a\u00f1o, lo que significa que el inventario de la TSCA cambia d\u00eda a d\u00eda. Hay otras sustancias qu\u00edmicas que no figuran en el inventario de la TSCA pero que est\u00e1n reguladas por otras leyes estadounidenses, como los pesticidas, los alimentos o los aditivos alimentarios, los cosm\u00e9ticos, los medicamentos, el tabaco y los productos del tabaco, los materiales nucleares y las municiones. Las sustancias qu\u00edmicas que no figuran en el inventario se consideran \u00abnuevas sustancias qu\u00edmicas\u00bb. Las sustancias con restricciones de fabricaci\u00f3n o uso est\u00e1n marcadas con banderas en el inventario de la TSCA.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Antes de fabricar o importar una sustancia qu\u00edmica, hay que comprobar si est\u00e1 incluida en el inventario. aria-labelledby=\"elementor-tab-title-1155\"><p><span data-contrast=\"auto\">El \u00faltimo paso de la revisi\u00f3n de la EPA es la \u00abNotificaci\u00f3n de inicio de fabricaci\u00f3n o importaci\u00f3n\u00bb, o NOC por sus siglas en ingl\u00e9s, que tambi\u00e9n puede presentarse electr\u00f3nicamente. Se presenta despu\u00e9s de que la EPA haya revisado la notificaci\u00f3n previa a la fabricaci\u00f3n. Toda persona que presente una PMN debe enviar electr\u00f3nicamente el formulario NOC a la EPA en un plazo de 30 d\u00edas naturales a partir de la fecha en que la sustancia se fabrique o importe por primera vez con fines comerciales no exentos. Si la NOC est\u00e1 completa, la EPA incluir\u00e1 la sustancia en el inventario de la TSCA. La fecha de recepci\u00f3n de la NOC completa por parte de la EPA es decisiva, aunque la tramitaci\u00f3n propiamente dicha dure unas cuatro semanas. La sustancia se considera entonces una \u00absustancia qu\u00edmica existente\u00bb a partir de la fecha en que la EPA recibe la NOC completa.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Las sustancias incluidas en la exenci\u00f3n de \u00abI+D\u00bb, es decir, producidas en peque\u00f1as cantidades y exclusivamente para la investigaci\u00f3n y el desarrollo, no requieren una NOC y pueden utilizarse o venderse despu\u00e9s del periodo de revisi\u00f3n de la PMN. Sin embargo, no se incluyen en el inventario de la TSCA, sino s\u00f3lo cuando se dispone de una NOC. No obstante, esto s\u00f3lo puede presentarse cuando se inicie la producci\u00f3n comercial, la sustancia ya no est\u00e1 en la fase de investigaci\u00f3n y desarrollo.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Hay m\u00e1s exenciones para las exenciones por bajo volumen (LVEs, por sus siglas en ingl\u00e9s), exenciones por baja liberaci\u00f3n\/baja exposici\u00f3n (LoREXs, por sus siglas en ingl\u00e9s), exenciones de mercado de prueba (TMEs, por sus siglas en ingl\u00e9s) y para los pol\u00edmeros que cumplen con las Enmiendas a la Regla de Exenci\u00f3n de Pol\u00edmeros de 1995. Para estas sustancias y para los usos no sujetos a notificaci\u00f3n, no se requiere un NOC. Las sustancias con dimensiones en el rango nano, es decir, aproximadamente de 1 a 100 nan\u00f3metros (nm), se denominan \u201cnanomateriales\u201d o \u201cmateriales o sustancias a nanoescala\u201d. A modo de comparaci\u00f3n: un cabello humano tiene un tama\u00f1o de 80.000 a 100.000 nan\u00f3metros. Una sustancia qu\u00edmica de tama\u00f1o nanom\u00e9trico puede tener propiedades diferentes a las de la misma sustancia qu\u00edmica con estructuras m\u00e1s grandes. Por ejemplo, la sustancia puede volverse m\u00e1s fuerte o m\u00e1s ligera y tambi\u00e9n tener una mayor reactividad qu\u00edmica. Esto suele ser \u00fatil para las aplicaciones comerciales, pero en el caso de algunas sustancias tambi\u00e9n provoca cambios en sus efectos sobre el medio ambiente o la salud. Para evitar riesgos en este sentido, la EPA ha regulado exhaustivamente los nanomateriales, recoge informaci\u00f3n sobre los nanomateriales nuevos y existentes y garantiza la disponibilidad de notificaciones previas para los nuevos nanomateriales. Las empresas deben proporcionar a la EPA informaci\u00f3n sobre las sustancias qu\u00edmicas espec\u00edficas que ya est\u00e1n en el mercado y son fabricadas, importadas o procesadas como materiales a nanoescala. Esto incluye detalles sobre la identidad qu\u00edmica espec\u00edfica, la cantidad de producci\u00f3n, los m\u00e9todos de fabricaci\u00f3n, los datos de salud y seguridad y la informaci\u00f3n sobre el procesamiento, el uso, la exposici\u00f3n y la liberaci\u00f3n de las sustancias. La EPA ha elaborado unas gu\u00edas orientativas sobre la recopilaci\u00f3n de informaci\u00f3n relativa a los materiales a nanoescala para fabricantes, importadores y procesadores, as\u00ed como para determinar si una sustancia a nanoescala es un producto qu\u00edmico \u00abnuevo\u00bb en el inventario de la TSCA. <\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Para limitar el riesgo que suponen los nanomateriales, la EPA ha limitado su uso en algunos casos, as\u00ed como su liberaci\u00f3n al medio ambiente, o exige el uso de equipos de protecci\u00f3n personal y controles de ingenier\u00eda. Tambi\u00e9n exige que se realicen pruebas sobre los datos sanitarios y medioambientales. Hasta cierto punto, la producci\u00f3n de nuevos materiales qu\u00edmicos a escala nanom\u00e9trica est\u00e1 permitida por la TSCA. Para ello se utilizan las denominadas \u00ab\u00f3rdenes de consentimiento\u00bb o \u00abnormas de nuevo uso significativo\u00bb (SNUR, por sus siglas en ingl\u00e9s). La producci\u00f3n de nuevos materiales qu\u00edmicos a nanoescala tambi\u00e9n puede permitirse bajo ciertas exenciones. Sin embargo, se aplican normas estrictas para controlar la exposici\u00f3n y evitar riesgos inaceptables como la liberaci\u00f3n en el medio ambiente.<\/span><\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-1157\" class=\"elementor-tab-title\" data-tab=\"7\" role=\"button\" aria-controls=\"elementor-tab-content-1157\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon elementor-toggle-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-closed\"><svg class=\"e-font-icon-svg e-fas-caret-right\" viewBox=\"0 0 192 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M0 384.662V127.338c0-17.818 21.543-26.741 34.142-14.142l128.662 128.662c7.81 7.81 7.81 20.474 0 28.284L34.142 398.804C21.543 411.404 0 402.48 0 384.662z\"><\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-opened\"><svg class=\"elementor-toggle-icon-opened e-font-icon-svg e-fas-caret-up\" viewBox=\"0 0 320 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M288.662 352H31.338c-17.818 0-26.741-21.543-14.142-34.142l128.662-128.662c7.81-7.81 20.474-7.81 28.284 0l128.662 128.662c12.6 12.599 3.676 34.142-14.142 34.142z\"><\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-toggle-title\" tabindex=\"0\">TSCA y PFAS<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-1157\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"7\" role=\"region\" aria-labelledby=\"elementor-tab-title-1157\"><p>Todas las empresas que fabriquen (incluidas las importaciones) o hayan fabricado (incluidas las importaciones) <a href=\"https:\/\/www.imds-professional.com\/es\/pfas\/\" target=\"_blank\" rel=\"noopener\">PFAS<\/a> o art\u00edculos que contengan PFAS desde el 1 de enero de 2011 deben notificar electr\u00f3nicamente informaci\u00f3n sobre el uso de PFAS, las cantidades de producci\u00f3n, la eliminaci\u00f3n, la exposici\u00f3n y los peligros. Dependiendo de su tama\u00f1o, las empresas afectadas tienen 18 o 24 meses despu\u00e9s de la entrada en vigor del reglamento (11 de octubre de 2023) para cumplir con su obligaci\u00f3n de informar.
