POP Regulation
The EU regulation on persistent organic pollutants (POPs) is being further tightened. For companies, this means stricter limits, new substances on the banned list, and additional compliance requirements. Here are the most important changes and dates:
1. PFOS limits drastically reduced
Delegated Regulation (EU) 2025/718 significantly reduced the limits for PFOS and related compounds:
- PFOS and salts: from 10 mg/kg to 0.025 mg/kg
- PFOS-related compounds (total): 1 mg/kg
- The exemption for chromium(VI) electroplating has been removed.
- Effective date: December 3, 2025.
2. New substances to be added to Annex I
The following substances are about to be added:
- Chlorpyrifos
- MCCPs (medium-chain chlorinated paraffins)
- C9–C21 PFCAs
- The public consultation ran until December 19, 2025, with entry into force expected in Q2 2026.
3. Additions from 2025
- Dechlorane Plus: listed in Annex I since October 2025, with phased UTC limits (1,000 mg/kg until April 2028, then 1 mg/kg) and exemptions for certain industries.
- UV-328: listed since August 2025, limits will be gradually reduced to 1 mg/kg by 2029.
4. Impact on companies
- Update compliance processes: take new limits and substance lists into account.
- Review supply chains: identify PFOS, Dechlorane Plus, UV-328, and potentially new POPs.
- Participate in consultations: secure influence on future regulations.
- Update CDX/material databases: integrate changed requirements.
