Proposition 65: Environmental and health protection in California

California’s Safe Drinking Water and Toxic Enforcement Act of 1986 is better known as Proposition 65. It is designed to protect the state’s drinking water sources from contamination with chemicals known to cause cancer, birth defects or other reproductive harm. It also requires companies to notify Californians about chemicals in their products if a release (exposure) is possible.
The state of California has published a list of proven hazardous chemicals, including asbestos, lead, bisphenol A (endocrine disruptor), cadmium and DEHP. It is forbidden to knowingly release these into drinking water sources. And a product warning must be displayed if a product contains one of these substances and exposure cannot be ruled out. Non-compliance with the regulations can result in heavy fines. The responsible authority is the Office of Environmental Health Hazard Assessment (OEHHA).
The Proposition 65 list has been partially incorporated into the GADSL and there is a separate basic substances group in the IMDS.
PFAS or “ forever chemicals” are perfluorinated and polyfluorinated alkyl substances that are used in numerous everyday products, are difficult to break down in the environment and can be harmful to health. You can read more about PFAS here.
As in other countries, they are also under surveillance in California. Perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS), for example, are already on the Proposition 65 list.
