EU Deforestation Regulation (EUDR)

EU Regulation 2023/1115 on the provision of deforestation-free products (EUDR) came into force on June 29, 2023. The aim is to halt deforestation and forest degradation worldwide by stipulating that certain raw materials and products may only be placed on the market or exported from the EU if they are certified as deforestation-free.

The EUDR applies to the following commodities and their products:

  • Beef
  • Cocoa
  • Coffee
  • Palm oil
  • Soy
  • Wood
  • Rubber
    as well as products made from them (e.g., furniture, paper, leather goods).
  • Due diligence: Companies must ensure that their products:
    • do not originate from areas that were deforested after December 31, 2020,
    • were produced in accordance with the applicable laws of the country of production.

  • Geolocation: The geographical coordinates of the cultivation areas must be specified for each delivery.
  • Due diligence declaration: A declaration must be submitted to the EU information system before the product is placed on the market.
  • Application for all affected companies: from December 30, 2025.
  • For small and medium-sized enterprises (SMEs): extended transition period until December 30, 2026.

Member States must establish effective sanctions, including:

  • Fines (up to 4% of annual turnover in the EU),
  • Confiscation of products,
  • Exclusion from public tenders.

EUDR information can be shared via the Chemistry Manager/Regulation Wizard.

  • Analyze supply chains and collect data on origin and geolocation.
  • Prepare processes for submitting the due diligence declaration.
  • Schedule training courses for compliance and supplier management.

The EU Commission has expanded the existing TRACES (Trade Control and Expert System) system for the EUDR.

  • Companies must submit their due diligence declaration electronically via TRACES (Art. 33 EUDR).
  • TRACES serves as a central platform for the transmission and management of EUDR data.
  • Access is via the EU login.
  • The declaration must be submitted before the products concerned are placed on the market or exported.
